WISEmed Privacy Notice

Introduction

This Privacy Notice explains how Fitzroy Emu LLC, dba WISEMed (“WISEMed” or “we”) collects, uses, shares, handles, secures, and processes information about Users of WISEMed’s website, mobile app, and related services (collectively, “Services”).  

We may periodically update this Privacy Notice to ensure that it reflects WISEMed’s current data privacy practices.  The Privacy Notice posted here always will be current, and we will notify Users of any material changes to the Privacy Notice via an email to the most recent email address on record with WISEMed.

Information Collection

WISEMed may collect the following types of User Information:

We also collect automated log data such as Internet Protocol (“IP”) address, MAC addresses, browser type, mobile device type, operating system, metadata, Internet Service Provider name, duration of time spent on the site, and the date and time that the User accessed the Services.

We may place cookies on Users’ computers or devices.  Cookies are bits of electronic information that can be transferred to Users’ computers or devices to uniquely identify Users’ browsers.  WISEMed may use cookies to connect Users’ activity on our website with other information we store about Users in their account profiles or their prior interactions with our website to, for example, store their preferences.  WISEMed also may use cookies to conduct measurement and analytics services and deliver relevant advertising to Users.  We also may allow third parties to use cookies, web beacons and similar technologies to better understand your behavior and browsing activities, so that we can serve you targeted advertising while you are on our Sites and display our ads to you when you visit other third-party sites.  At any time, Users may adjust their browser settings to refuse cookies according to the instructions related to their browsers.  Please note that if Users disable their web browsers’ ability to accept cookies, Users may not be able to access all features and functions available via the Services.  Unless Users have adjusted their browser settings so that they will refuse cookies, our system will place cookies when they log on to our Services.  For more information about how to manage cookies in a web browser, see http://www.aboutcookies.org. WISEMed does not respond to Do Not Track signals on web browsers, as the industry has not settled on a Do Not Track Compliance standard.

If you access WISEMed’s Services via a Third-Party Institution (i.e., your employer subscribes to WISEMed), that Third-Party Institution may provide WISEMed with personal information that is necessary for WISEMed to deliver the Services to you.  WISEMed will handle and process that personal information under the principles outlined in this Privacy Notice.  The Third-Party Institution is solely responsible for the initial collection of this personal information and the transfer of this personal information to WISEMed.

WISEMed’s Services are not directed to children under the age of 13.  WISEMed does not knowingly store or collect information from children under the age of 13.

If a User would like to review or request changes to information stored on the Services and is unable to do so via the website or mobile app, the User may email privacy@wisemed.org.

This Privacy Notice does not apply to anonymized, de-identified, or aggregated information.

Information Sharing

WISEMed may provide third parties with the information that it has collected from or about a User under the following circumstances:

If a User’s subscription to the Services has been purchased by the User’s affiliated institution, WISEMed may provide that affiliated institution with all records and information related to the User, including but not limited to results on online performance assessments.

WISEMed’s Services may provide you with the option to integrate the Services with social media services, including but not limited to Facebook.  Any information that you provide via these social media services will be subject to the social media services’ privacy policies, terms of use, and other policies.  WISEMed does not have any control over the privacy policies, privacy practices, or user experience on these social media services.  You understand and agree that WISEMed is not responsible for any acts or omissions of these social media services.   You also understand and agree that if you integrate your social media account with WISEMed, your social media service will transmit certain information associated with your account to WISEMed.  You agree that if you choose to integrate your social media account with WISEMed, WISEMed may provide certain personal information to the social media service, and the social media service may provide certain personal information to WISEMed.

Data Security

WISEMed takes commercially reasonable measures to protect User Information from unauthorized access, alteration, disclosure, or destruction.  These include the use of encryption to protect personal information in transit, and the use of cloud storage providers that comply with industry standards. 

Your California Privacy Rights

The California Shine the Light Law requires companies to disclose whether certain information shared with third parties is used for the third parties’ direct marketing purposes.  WISEMed does not share Users’ personal information with third parties for the third parties’ direct marketing purposes.  Nonetheless, if you are a California resident, you may request information about the disclosure of your personal information to third parties for the third parties’ direct marketing purposes by emailing privacy@wisemed.org.

Rights Under the Family Education Rights and Privacy Act (FERPA)

Under certain circumstances, if you enroll in a program that we offer in conjunction with a partnering educational institution, the disclosure of certain Personal Information that you provide to us, and/or information that we may create or receive from our partnering educational institutions that pertains to you, may be protected under FERPA, if applicable. You may also have specific rights related to accessing and/or updating your Personal Information when FERPA applies. International Transfers

WISEMed’s headquarters is in the United States and, regardless of where you use our Services or otherwise provide information to us, you understand and agree that your information may be transferred to, maintained, and processed by WISEMed and our service providers in the United States or other jurisdictions in which we or they operate.  By providing personal information to the Services, you consent to this transfer.  Please note that privacy laws, regulations, and standards in the jurisdictions in which your information may be maintained and processed may not be equivalent to the laws in your country of residence and such information may be subject to lawful access by U.S. or other foreign courts, law enforcement, and governmental authorities.
